Constitution of Nepal 2015 (Nepali Name: नेपालको संविधान
२०७२) is the present governing Constitution of Nepal. Nepal
is governed according to the Constitution which came into
effect on Sept 20, 2015, replacing the Interim Constitution
of 2007.[1][2] The constitution of Nepal is divided into 35
parts, 308 Articles and 9 Schedules.[3]
The Constitution was drafted by the Second Constituent
Assembly following the failure of the First Constituent
Assembly to produce a constitution in its mandated period
after the devastating earthquake in April 2015. The
constitution was parties which refrained from the voting
process.

Nepal is promulgating a new constitution 2072 on 20
September 2015. President Ram Baran Yadav had been
officially promulgating the new constitution in the presence
of Constituent Assembly members as well as in the presence
of national and international diplomatic community.
The Constituent 2072 written by Nepali people and for Nepali
people is a dream come true for Nepal. It took almost seven
decades for Nepali people to realize this dream- a historic
moment indeed.
However, although the country has welcomed this
constitution, section of the indigenous community including
Madhesis, Tharus and Janajatis have not fully agreed with
the Constituent.
A cross section of indigenous peoples are
protesting it as it has failed to address their demands of
demarcation of provinces, republican set up among others.
There are 33 parties who boycotted the Second Constituent
Assembly Election and are not part of the present
Constituent Assembly. 33 parties who now remain out of
Constituent Assembly have since the very beginning demanded
for an all party roundtable national conference and form a
national government by dissolving the present Constituent
Assembly.
In the midst of all this, there has been agitation and few
violent protests going on in many parts of the southern (Terai)
part of Nepal. The government has imposed curfew and strict
prohibition against public demonstration and movement in
some of the areas in southern part of Nepal. In the past few
weeks, many people, both protesters and security personnel,
have sadly lost their lives.
Only 31 parties contested the Second Constituent Assembly
Election. These 31 parties currently present in CA is
preparing to promulgate the new constitution. However, even
among these 31 parties there is strong conflict and
disagreements on several important issues. For instance,
some of the parties are for Federal structure and others are
against it; some are in favor of secular system while others
want the constitution to declare Nepal as a Hindu state. And
still many others are not happy with demarcation of the
federal states.
I personally feel the Nepal is at a historic moment. I hope
there will soon be a national dialogue in the coming days
and the political consensus would be reached and
constitution will be able to address the pending issues in
due time. I am truly optimistic that democracy and republic
in Nepal has come at a huge cost of the sacrifices made by
Nepali people and it would be our moment of joy and pride to
see Nepal declare a constitution as soon as possible and
forge along the path of development and prosperity.
